IEEPA Tariff Refunds from carrier customs brokerage entries

Question:

It may be a bit early to address this, but I would appreciate members’ insights.

When importing goods using third-party logistics providers that also handle customs clearance, duties and fees are often billed separately by those providers. In these cases, the entries may not appear in ACE reports under the importer’s name, as the importer of record may be listed differently.

In this scenario, how are potential IEEPA tariff refunds typically handled? Would the party that ultimately bears the cost of the duties be eligible to claim a refund, or would that fall to the party listed as the importer of record?
